    Correct, but the only thing is I want people to be able to purchase it and go to the appearance > Themes > install theme and upload it there as a zip. Any ideas why that error typically happens?

    The reason I was asking about staying away from that method is if I wanted to distribute the theme I create, most people I think are more familiar with dealing with menus in the appearance section rather than as a widget. So, I was trying to figure out a way to do this while still having the menu selected through the menu area of the appearance panel.
