Has anyone had any success in getting the GDPR comment consent checkbox to show up properly on XHTML child themes? The checkbox is showing up fine on all site that have HTML5 themes, and when I temporarily (and very sloppily) convert a XHTML theme to an HTML5 theme, the comment consent checkbox shows up just fine. But I can't figure out how in the world to make it work on XHTML themes.

I did submit a ticket to support about this, and they said that "The commenting system in Genesis is the same one used in WordPress, just with a Genesis wrapper." But that doesn't seem to mean that XHTML themes are using the native WordPress commment template which is apparently required for the checkbox to show up. They told me to ask my question in the community forums.

Is there a way to force XHTML themes to use the native WordPress comment template so that the built-in consent checkbox will show up like it does on HTML5 themes?

(And yes, I know if I just update the themes to HTML5, that'd solve the problem, but there are a number of my clients still on a highly customized XHTML child theme that don't have the time of money to update at this time).

Genesis themes don't have their own comment form. Unless the theme developer explicitly overrode the WordPress defaults, they use the built-in WordPress comment form that supports both HTML5 and XHTML. It would help if you told us what theme you're using. You may have to include an add_theme_support directive to WordPress knows to use the XHTML version.
